TERMS AND CONDITIONS FOR JIWANTA HEALTH
Welcome to Jiwantahealth.com, an online delivery platform and medical ecommerce website that you can access through our phone, email, web application, text, Viber, messenger and WhatsApp (“Platform”). Please read the Terms of Service (denoted as “Terms”) carefully because they will serve as an agreement between you and Jiwanta Health. Our products and Platform are collectively called the “Products” henceforth.
Jiwantahealth.com is a Medicine Delivery Platform and Medical Ecommerce website. Jiwantahealth.com enables you to place an order for your prescription medication and other medication and health supply needs (“Order“) and acts as a delivery management platform only. Each medication that you order through jiwantahealth.com must be based on a valid prescription issued for a legitimate medical purpose. The Services are not intended to be replacement for professional medical advice, diagnosis, or treatment, and do not constitute medical or other professional advice. Jiwantahealth.com does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Services or by any other electronic means. Reliance on any information provided by Jiwantahealth.com is solely at your own risk. The information provided through Jiwantahealth.com‘s Services is designed to support, not replace, the relationship that exists between patient/site visitor and their physician/doctor. You should not disregard professional medical advice or delay in seeking it because of something you have read or seen on our Services.
When you place an Order through jiwantahealth.com, we work with a pharmacy that processes your Order and fills your prescriptions (each, a “Pharmacy”). You acknowledge and agree that jiwantahealth.com is not a pharmacy and that we don’t fill prescriptions ourselves nor do we manufacture, prepare, dispense, or provide medications of any kind. You also acknowledge and agree that, although we may select certain pharmacies to work with based on our internal criteria, our decision to work with a specific pharmacy should not be deemed as an endorsement of, or a warranty regarding the quality of services provided by, such pharmacy. If for any reason, you aren’t satisfied with how the Pharmacy processed your Order, we will facilitate you to address this issue with the Pharmacy directly.
You also acknowledge and agree that we do not provide any medical advice, opinion, diagnosis, or treatment and that no pharmacy-patient relationship or doctor-patient relationship is, or will be, established between jiwantahealth.com and you as a result of your use of the Services or otherwise. You should consult your physician/doctor and or medical practitioner regarding dosages, precautions, warnings, interactions, and contraindications before administering or using any medications. If you have any questions regarding your prescriptions, you should consult your medical practitioner or pharmacist, whose contact information may be listed on the prescription or in the packaging of your prescription medicine.
You acknowledge and accept that the order for a substitute of a Prescription Drug would only be processed if you with the consultation with the medical expert/ doctor has himself/ herself permitted for any other equivalent brand or generic drug to be dispensed in place of the Prescription Drug in the prescription.
WHO MAY USE
You may use the Services only if you are 18 years or older, are capable of forming a binding contract with jiwantahealth.com, and are not barred from using the Services under applicable law.
Although it is not compulsory to create an account to purchase, if you want to get benefits from certain offers, you’ll have to create an account (“Account”) via the Platform. You must provide us with accurate, complete, and up-to-date information for your Account and you agree to update such information to keep it accurate, complete, and up-to-date. If you don’t provide us with accurate information (or do not update the information to keep it accurate, complete, and up-to-date), we may suspend or terminate your Account. You agree to keep your Account password confidential and you’ll let us know immediately if there is any unauthorized use of your Account. You’re responsible for all activities that occur under your Account, whether or not you know about them so please safeguard your Account password and other related information.
DELIVERY OF YOUR ORDER
Before any delivery is made, our delivery person will make an appointment with you to confirm the time and location of the delivery. If no one is present at your delivery address at the time of delivery to receive the order, the buyer may have to wait for the next delivery schedule.
We at jiwantahealth.com make sure you are entirely satisfied with our products. We do our best and based on the following conditions, we will gladly grant a full refund:
- The order the faulty;
- During delivery the order(s) is lost or damaged;
- In case of the order(s) has passed its expiry date.
Depending on the circumstances, the refund process can differ. Please permit 7 to 10 working days to be credited to your account when refunding via credit/debit card or mobile banking. Credit should be issued within 48 hours if the refund mode is by cash on delivery.
Items that cannot be refunded or returned include:
- Baby Care: Bottle Nipples, Breast Nipple Care, Breast Pumps, Diapers, Ear Syringes, Nappy, Wet Reminder, Wipes and Wipe Warmers.
- Temperature Controlled and Specialty Medicines: Vials, Injections, Vaccines, Penfills, and any other Product, requiring cold storage, or medicines that fall under the category of specialty medicines.
- Sexual Wellness: Condoms, Fertility Kit/Supplement, Lubricants, Pregnancy Kits.
- All items with Unreturnable are listed on the items at the website.
You may remove a prescription from your Account or cancel a particular prescription at any time before an Order is placed for that prescription.
Your opinion matters to us! We welcome feedback, comments, and suggestions for improvements of Services (“Feedback”). You can submit Feedback by emailing us at email@example.com or filling up the Feedback form at the website. If you provide us any Feedback, you agree that we may use, copy, modify, create derivative works of and otherwise use the Feedback for any purpose.
LINKS TO THIRD PARTY WEBSITES OR RESOURCES
The Services may contain links to third-party websites or resources. We are not responsible for the content, products or services on or available from those websites or resources. You acknowledge sole responsibility for and assume all risk arising from, your use of any third-party websites or resources.
You will indemnify, defend and hold harmless jiwantahealth.com and its owner, directors, employee from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Services, or (ii) your violation of these Terms.
These Terms and all transactions entered into, on or through the Website and the relationship between You and jiwantahealth.com shall be governed under the applicable Laws of Nepal. You agree that all claims, differences, and disputes arising under the relationship between You and jiwantahealth.com shall be subject to the exclusive jurisdiction of the courts of Nepal. You hereby agree to and accept the jurisdiction of such courts.
The Terms will continue to apply until it is terminated either by You or Jiwantahealth.com as set forth below.
If you want to terminate Your agreement, you may do so by discontinuing the use of the Website/your account at jiwantahealth.com.
AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and jiwantahealth.com (“we,” “us” or “our”), concerning your access to and use of the jiwantahealth.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.
